Apostille to France

Recently, I had the pleasure of completing a couple of California Apostilles going to France for a lovely French women.

In order to continue collecting her French social security (attestation d'existence pour le paiement des retraites from the caisse nationale d'assurance vieillesse) and pension (paiement de votre pension) on a yearly basis she has to return a form to France verifying that she is still alive.

In previous years it was enough for her just to have the form notarized but this year they sent it back stating that they required an Apostille. Because she resides in California, she needed an Apostille from California.

I was happy to be able to provide this service for her, as she is an older woman who does not drive so it would have been very difficult for her to complete this herself. She was very grateful that she was able to find someone to complete this service (Apostille) for her.

My boss asked me to notarize the same type of document but because it was the first time notarizing a foreign document I needed to verify with the Nat'l Notary Ass'n about the Apostille and I was informed that Notaries DO NOT have the authorization to verify if someone is alive, deceased or their place of residence. They (the NNA) informed me that my boss has to go the country's consulate for the proper seal and stamp. You should confirm this as well prior to notarizing another one of these documents.

While I appreciate your concern, I've been a notary for 5 years now so I am fully aware of what I am allowed to do as a notary.

As a notary I verify the identity of the signer and watch him or her sign the document. It is not my responsibility to read the document (reading the document increases your liability). I am to glance over the document to make sure it is complete and then perform the notarization.

The client was the one that filled out the form, not I, so I personally did not vouch for anything except her identity.

And as a heads up, the NNA is notorious for giving out erroneous information. They are an association, not the governing body for all notaries. The Secretary of State handles the laws governing notaries.

Hello.. Thats good. Now i guess an apostilled document is prefered to notarized
